Terms & Conditions

1.1. These Terms & Conditions form a part of our contract to provide fitness services to you. You will be asked to acknowledge you have read and agree to these Terms and Conditions on our Risk Acknowledgement prior to participating in any of our fitness classes.
1.2. The Pure Will Code of Conduct also forms part of your Contract for services with Pure Will. Breach of these Terms and Conditions or the Pure Will Code of Conduct may result in suspension or cancellation of your Membership without notice.
1.3. These terms and conditions are subject to change. All Pure Will members will be given reasonable notice of any significant changes to the terms and conditions of service.
2.1. Preferred Payment Option – Direct Debit: Pure Will uses Ezidebit to manage payments arrangements and any changes to your Membership or payment arrangement requires at least two weeks (14 calendar days) notice in writing, including cancellation, changes in payment frequency and pauses.
2.2. Methods for written notice include emailing [email protected] and/or completing a Change to Membership Arrangement Form and return in person or by email.
2.3. Other Payment Options: Pure Will prefers Direct Debit, but for fixed term training arrangements or once off purchases Pure Will may also accept Direct Deposit.
3.1. A Standard Membership Arrangement refers directly to ongoing Direct Debit agreement for services provided by Pure Will paid on a weekly or fortnightly basis.
3.2. Under a Standard Membership Arrangement each payment is made in advance of the Membership period. Memberships are only valid for that paid period but are extended when the next payment is received.
3.3. Our standard payment frequency is fortnightly. Each fortnightly debit covers you for the following 14 day period.
3.4. This rolling Membership renewal arrangement will continue until the Direct Debit arrangement is cancelled or paused by you or Pure Will.
4.1. Two Week Cancellation Policy: For our Standard Membership Arrangement Pure Will requires two weeks (14 calendar days) notice in writing to change the Direct Debit arrangement to cancel payments and your Membership.
4.2. Other payment arrangements, including Fixed Term Arrangements, may have additional conditions.
4.3. Members with a Standard Membership Agreement are entitled to pause their membership for up to 4 weeks per year, either in bulk or as two fortnightly pauses.
4.4. Pure Will does not pause Memberships for weekly absences.
4.5. If you cancel or pause your Membership for more than 4 weeks in a calendar year your Membership will be considered inactive and cancelled. If you re-sign with Pure Will at a later date you do so as a new Member and may not be entitled to continue your Membership on a previous discount or payment arrangement.
5.1. Other common payment arrangements refers to Fixed Term Membership Arrangements and Fixed Term Training Arrangements, which include all services agreements that are paid for in advance for periods longer than 2 weeks (14 calendar days), and arrangements purchased on session basis, with or without an expiry period.
5.2. These types of payment arrangements are used for Personal Training, Private Bookings and longer term Fitness Studio Memberships or Bootcamps.
5.3. Fixed Term Membership Arrangements and Fixed Term Training Arrangements may vary from agreement to agreement and may have additional terms and conditions, including expiry dates, which will be confirmed in email prior to commencement.
6.1. Fixed Term Membership Arrangements and Fixed Term Training Arrangements are paid for in advance and cannot be cancelled or refunded except where required by law.
6.2. If a payment instalment arrangement is agreed to in order to pay for a Fixed Term Membership Arrangements or Fixed Term Training Arrangements, this cannot be cancelled or refunded, except where required by law. Payments will continue to be debited until full payment is received.
6.3. Fixed Term Membership Arrangements and Fixed Term Training Arrangements cannot be paused, cancelled or put on hold.
6.4. Where an arrangement is purchased on a per session basis with an expiry date, the expiry date invalidates any outstanding sessions not booked and used within that period.
7.1. Before we allow you to participate in Pure Will training it is mandatory that you read these Terms and Conditions and complete and sign the Pure Will Risk Acknowledgement and Basic Health Screen forms.
7.2. Where you answer ‘yes’ to any of the questions on the Basic Health Screen Pure Will may require you to see an appropriate medical professional for clearance to initiate a training program before permitting you to participate in our training services.
7.3. You must inform Pure Will of any and all conditions that may effect your ability to participate safely in an exercise sessions or activates, or that pose any risks to yourself, other participants or the Trainer.
7.4. If you become injured, your health status changes or you become aware of any circumstance that puts you at risk while training (including overtraining) it is your responsibility to inform your trainer as soon as possible.
7.5. In the instance where you have a medical condition but are cleared to exercise, it is still solely your responsibility to manage that condition before, during and after participating in Pure Will activities.
8.1. We want what is best for you and our first priority is your health. Sometimes training with us may not be right for you and we reserve the right to refer you to specialists or health professionals and refuse to train you until written clearance to exercise from that specialist or health professional is received.
8.2. You must not participate in any Pure Will activities if you are not fit to do so. This includes being ill, injured, under the influence of alcohol or drugs or any other instance where your condition creates a danger to yourself or others while participating.
8.3. If you are sick, out of respect for your trainers and the other people trying to keep fit and healthy, stay home. If we feel you are putting yourself or others at risk we will send you home to rest.
8.4. Pure Will reserves the right to refuse service to individuals where we deem participation in our activities would be contraindicative to their health or the health of others.
9.1. Pure Will Fitness Studio is an indoor facility and is not subject to most weather conditions. However, extreme heat or cold may impact the environment within the facility, so please come prepared.
9.2. All Pure Will outdoor training, including Private Bookings, Personal Training and Bootcamps, continue in all conditions, including wet weather and winter. Arrangements may be made for indoor or undercover locations. This may require a shift in geographic location.
9.3. It is up to the Trainer to make the final decision on whether a session is cancelled or moved due to weather conditions. Sessions cancelled in the event of severe weather will not be refunded. However, we will endeavour to reschedule that session for another date. You will be notified by Facebook, email or phone will if a session is cancelled or moved.
10.1. No refund is given for payments for any advance payments, including Standard Membership Arrangements, Fixed Term Membership Arrangements and Fixed Term Training Arrangements, except where required by law. We do not offer refunds for change of mind or non-usage.
11.1. Lateness can become a safety issue as critical information is normally passed on at the beginning of a session. The beginning of a session is also the normal time for a warm-up, which is important for safely moving into more intense exercise. It may also distract other Members of the group and will certainly distract the Trainer.
11.2. Pure Will reserves the right to exclude anyone who arrives late to a session.
12.1. If you are on a Standard Membership Arrangement we require two weeks (14 calendar days) notice in writing to cancel. Please ask for a Change of Membership Arrangement Form.
12.2. Transfers of Fixed Term Memberships and Fixed Term Training Arrangements are allowed in certain circumstances and after consultation and approval with Pure Will.
12.3. Fixed Term Memberships and Fixed Term Training Arrangements cannot be cancelled.
12.4. Please see sections 4 & 6 for more information about cancelling arrangements.
13.1. All Personal Training sessions are booked in advance and paid for in full at least 24 hours before the session is confirmed. Call 0435 372 369 or email [email protected] for booking information.
13.2. Personal Training Cancellation Policy: Our Personal Training, including mobile Personal Training, cancellation and reschedule policy requires 12 hours notice prior to a session.
13.3. Cancellations with at least 12 hours notice must be rescheduled within the next fortnight.
13.4. If you cancel within 12 hours notice we cannot reschedule and no refund will be given.
13.5. Personal Training Late Policy: If you are late, your Trainer is not obliged to extend your session, which may still finish at the scheduled time.
13.6. If you are more than 10 minutes late and you have not notified your trainer by phone it is considered a no show. Your Trainer may not wait any longer for your arrival. No refunds or rescheduling for no shows or cancellations within 12 hours.
13.7. If your trainer is up to 5 minutes late (with notice), they owe you 20 minutes of additional training on their own time, perhaps at the end of, or before, your next session, if that is convenient for you.
13.8. If your trainer is 5 minutes late or more, or they cancel with less than 12 hours notice, they owe you a reschedule and a free session.
13.9. If your trainer cancels with more than 12 hours notice, you are entitled to a reschedule.
13.10. If your trainer does not show to a session and has not notified you before hand, they owe you a reschedule and 2 free sessions.
14.1. The Small Group Personal Training and Private Group Training lateness policy is as per the Personal Training lateness guidelines. However, it differs in that a session will start on time if at least one person from the group has arrived.
14.2. Lateness can become a safety issue as critical information is normally passed on at the beginning of a session. The beginning of a session is also the normal time for a warm-up, which is important for safely moving into more intense exercise. It may also distract other Members of the group and will certainly distract the Trainer.
14.3. Pure Will reserves the right to exclude anyone who arrives late to a session.
14.4. Make up sessions, re-booking or rescheduling is not available if one person can’t make it but the other person or people show up.
14.5. Cancellations or rescheduling requires at least 24 hours notice.
14.6. Drop Outs from Private Bookings or Small Group Personal Training: In the case where one person leaves the group and the group was on a Fixed Term Training Arrangements, there are no refunds, however, that participant may be replaced at the discretion of the Trainer. In the case where one person leaves the group and the group was on an Ongoing Training Arrangement, or the Fixed Term Training Arrangement has reached a new period of training requiring new payment, there are two options;
14.6.1. At the discretion of the Trainer, find a replacement person; or,
14.6.2. Adjust the fee of each participant to cover the total cost.
15.1. Pure Will reserves the right to suspend Membership and refuse service to any individual who breaches these Terms and Conditions, fails to meet payment arrangements or breaches our Code of Conduct. Refunds for unused periods of service will be offered in circumstances where Pure Will refuses service to an individual.
